IANAL and I don’t play one on TV, but. Technically speaking, Korman telling David — that he “can” mail the exchange to whomever is not a permission, although it could be argued otherwise (lawyers will argue anything in court if they are properly motivated). Had Korman told him “You may e-mail this to whomever…” then it would definitely be a permission. The “can” technically means David — has free agency and nothing stops him from doing whatever the hell he wants. They are both lawyers, they both know this. Their bread and butter comes from parsing language like this.
Therefore, this entire affair is not two, but at least two and perhaps three (more?) attorneys practicing at the law highwire, live and without a net. Maybe someday, some of them will turn pro and can stop practicing. Or something like that. That’s my 2 cents and I’m sticking to it.

I *am* a lawyer, and I can guarantee you that in informal usage, the word “can” connotes permission as well as ability. Furthermore, the quote in question comes in response to “David” asking:
“So, finally, can I forward this along to some folks?”
Clearly, David is asking permission and Korman grants it. As you say, they are both lawyers and know exactly the repercussions of their language. A jury would pretty much laugh any other explanation out of court.
I applaud her, she did the right thing, and brand new lawyers everywhere are applauding her. Everyone knows that experienced lawyers abuse new associates and treat them like slaves.
1) He offered her one salary, and then lowered it with the claim that he needed to hire two people. Sleazy.
2) As an experienced lawyer he should know:
a) Put it in writing and have it signed by both parties. Thats what you tell your clients, right?
b) DonââŹâ˘t forward email between you and another party, especially if it is a contentious exchange and tell them FORWARD TO WHOMEVER YOU WANT.
Why should she have to stand for his crap?
